Berne does not f...Nice post; just one small grouse. Berne does not flatly prohibit formalities. Berne prohibits formalities that interfere with the exercise and enjoyment of copyright. So formalities that differentiate between different kinds of remedies available to those who register, vs. those who don't, are fine. Which is what we have not. And I think we could go further -- we could say, I think, that unregistered works are not entitled to a derivative works right, or they are subject to sharp limits on actual damages.
